The appointment types are based on the SUNY Policies of the Board of Trustees.
Continuing (Policies of the Board of Trustees, Article XI, Title B)
Continuing appointment is the appointment to a position of academic rank which shall not be affected by changes in such rank and shall continue until resignation, retirement, or termination. It is granted by the Chancellor after recommendation by the President. Faculty are eligible upon completion of seven years of service in the academic rank of Assistant Professor, Senior Assistant Librarian, Assistant Librarian. Faculty in the ranks of Professor, Associate Professor, Librarian, or Associate Librarian are eligible upon initial appointment or thereafter (upon the completion of three consecutive years of service, further employment must be on the basis of continuing appointment).
Management/Confidential (Policies of the Board of Trustees, Article IX, Title B)
Management/Confidential (M/C) professional appointments are at the discretion of the President and are not represented by a union/bargaining unit. M/C employees serve at the pleasure of the President and has no tenured status in such position. M/C positions are either policy makers, or involved in a significant way in administering labor agreements (vice presidents, deans, human resources).
The M/C group, as defined by the Taylor Law, includes New York State employees with a variety of backgrounds and expertise, encompassing a broad range of occupations. In this group are policy-making managers, middle managers, and specialists in fields as diverse as education, law, computer science, medicine, administrative support, and law enforcement. The Taylor Law, while it authorizes collective negotiations for most of New York State's public employees, does not permit M/C employees to organize or to bargain collectively on terms and conditions of employment due to the nature of the work their positions require, as defined by that law.
Permanent (Policies of the Board of Trustees, Article XI, Title C)
Permanent appointment may be granted to a professional employee who has completed seven consecutive years of full-time service (including temporary) in a professional title, provided the last two or more years have been in the same budget title. Employees serving in titles designated as Appendix A, B or C of the Policies are not eligible for permanent appointment. Part-time service and periods of leave at partial salary or without salary is not included in the computation. The granting of prior service credit (up to 3 years) may shorten the timeline to permanent appointment. This recommendation requires the approval of the President and the Chancellor.
Probationary (Policies of the Board of Trustees, Article XI, Title E)
A probationary appointment must be granted for a one-year period to a professional employee holding a professional title when the employee is appointed to a different professional title. A probationary appointment may be terminated at any time, in which case the employee shall return to the previous budget title for at least the unexpired portion of the prior term appointment in that title. A probationary appointment recommendation requires the approval of the President.
Temporary (Policies of the Board of Trustees, Article XI, Title F)
An appointment which may be terminated at any time. Temporary appointments ordinarily shall be given only when service is to be part-time, consistent with section 2 of Title D, Article XI, voluntary, or anticipated to be for a period of one year or less, or when an employee's initial appointment in the University is made to a position vacated by a professional employee who is serving a probationary appointment pursuant to Title C, section 5, or Title D, section 6. A temporary appointment is also appropriate whenever a position has been vacated by an employee on approved leave.
Term (Policies of the Board of Trustees, Article XI, Title D)
A term appointment shall be an appointment for a specified period of not more than three years, which shall automatically expire at the end of that period unless terminated earlier because of resignation, retirement, or termination. Term appointments may be renewed for successive periods of no more than three years each. No term appointment, of itself, shall be deemed to create any manner of legal right, interest, or expectancy in any other appointment or renewal. Any further employment in a professional title, which is permanent eligible, of a professional employee who has completed seven consecutive years of full-time service as a professional employee at the college, the last two years of which have been in that professional title, must be on the basis of permanent appointment, provided that such appointment shall not be effective until made so by the Chancellor.
Further employment of a part-time employee beyond four (4) consecutive semesters in a professional title shall be a term appointment. An individual who has been granted a term appointment, but for whom classroom enrollment is inadequate, shall have no entitlement to salary, benefits, or any other rights or privileges.
